ESR Agent Recognition Programme – T’s & C’s

Entry to the programme will be via qualifying for Accor’s paid loyalty programme, Accor Plus. An annual membership subscription programme valid throughout Asia Pacific and linked to Accor’s global loyalty programme Accor Live Limitless.


Receive ESR Australia & NZ Recognition points for business secured on a new leasing deal where the lease commences on or after 1 March 2022, to be redeemed within the Accor Live Limitless loyalty programme in partnership with ESR Australia & NZ.

This promotion is offed on the basis of these terms and conditions and applies to any new leasing transaction completed and commencing on or after 1 March 2022 within ESR Australia’s portfolio of properties.


Earning Recognition Points:

  1. All leasing agents (“Agents”) engaged by ESR Real Estate (Australia) Pty Ltd (or another entity within ESR Real Estate (Australia) Pty Ltd’s corporate group or to a fund managed by such entity – “ESR Australia & NZ”, which, for the avoidance of doubt, does not include members of, or funds previously managed by, the LOGOS or ARA groups of companies) to assist with the sourcing and engaging of tenants for ESR Australia & NZ owned or controlled properties are eligible for ESR Recognition points (“ESR Points”) under this Agent Recognition Programme.
  2. This Agent Recognition Programme applies to all properties in ESR Australia & NZ's portfolio of managed properties, including stabilised and development assets, but does not apply to properties listed in Schedule 1.
  3. ESR Points will, in ESR’s sole discretion, be awarded following the execution of an unconditional agreement to lease (“AFL”) or lease, for a lease term of not less than three years, executed and commencing on or after 1 March 2022, between a customer and ESR Australia & NZ (“Qualifying Leasing Agreement”), for any of the available space within the Australian portfolio. If more than one agent has acted, the award will be allocated at ESR Australia & NZ's discretion.
  4. The Qualifying Leasing Agreement must relate to vacancies or developments at property owned by ESR Australia & NZ but excludes any introduction to a customer where ESR Australia & NZ has already entered into discussions, an AFL or lease, or other documentation in relation to any ESR Australia & NZ's premises.
  5. Agents may only accrue ESR Points once in relation to each Qualifying Leasing Agreement. In relation to a leasing transaction, for the avoidance of doubt, if an AFL and a lease are both executed in relation to the same property, this will constitute one Qualifying Leasing Agreement.
  6. ESR Australia & NZ’s decision in relation to any aspect of the promotion is final, and no correspondence will be entered into.
  7. For leasing transactions, ESR Points will be awarded to Agents following the payment of commission by ESR Australia & NZ to such Agent (“Commission”), on the basis of 4% of Commission paid.


Claiming Reward Points:

  1. Once the Qualifying Leasing Agreement has been executed, ESR Australia & NZ will allocate points to the agent.
  2. On receipt of leasing data, ESR Australia & NZ, in its sole discretion, will determine the total number of Reward Points to be awarded to the agent and assign these to the individual on a ESR Points tracking database (which will be managed by ESR Australia & NZ and Accor jointly).
  3. Each Agent agrees and acknowledges that they cannot in any circumstance convert the Reward Points into any monetary value or redeem them against money remittance.


General:

  1. By participating in this Agent Recognition Programme, each participant agrees that their name, points balance and total points accumulated may be displayed on ESR’s website, which will be updated from time to time.
  2. ESR Australia reserves the right to terminate the Agent Recognition Programme at any time. Upon termination, any ESR Points to which Agent may be entitled, but which are yet to be issued, will be forfeited without further notice and ESR Australia & NZ'’s obligations under these terms and conditions will immediately come to an end.
  3. ESR Australia is not responsible for any tax liability or other statutory charges and levies (including but not limited to income tax, payroll taxes and fringe benefits tax) that you or any third party (including a participant’s employer) incurs arising from or in connection with your participation in the Agent Recognition Programme.
  4. These terms and conditions are governed by and construed in accordance with the laws of New South Wales, Australia.




Accor Live Limitless:

  1. Once points have been rewarded by ESR Australia & NZ, the agent will be entered into the Accor Live Limitless programme (ref Terms and Conditions)
  2. Upon entering the ALL- Accor Live Limitless Programme, the agent will agree to the sharing of data relating to their stays with Accor Live Limitless back to ESR Australia & NZ. The data will be used for the purpose of understanding how agents have used their awarded points within the Accor Live Limitless programme to inform future ESR Australia & NZ Agent Recognition Programme enhancements and/or any related marketing activity.
